These Conditions of Hire (“Conditions”) govern the rental and use of buses and related services provided by Shri Sai Travels & Buses (“the Company,” “we,” “us,” or “our”). By booking, hiring, or using any bus or service (“the Hire”), you (“the Hirer,” “you,” or “your”) agree to be bound by these Conditions on behalf of yourself, your group, and any passengers. If you do not agree, do not proceed with the Hire. These Conditions form a legally binding contract and supersede any prior understandings.

1. Definitions
  • Bus: Any motor vehicle provided by the Company for passenger transport, including coaches, minibuses, or similar.
  • Hire Period: The duration from pickup to drop-off as specified in the booking confirmation.
  • Driver: A licensed professional provided by the Company, if applicable.
  • Passengers: All individuals transported under the Hire.
  • Force Majeure: Events beyond our reasonable control, such as natural disasters, strikes, government restrictions, or mechanical breakdowns.
2. Booking and Confirmation
  • Bookings must be made via phone (+91 93731 98040), email, or our website and require full details of the Hirer, itinerary, passenger count, and Hire Period.
  • We reserve the right to refuse or cancel bookings due to unavailability, incomplete information, or non-compliance with these Conditions.
  • A booking is confirmed only upon receipt of a written confirmation (email or SMS) and the required deposit (50% of total Hire fee, unless otherwise agreed).
  • All Hires are subject to vehicle and Driver availability. We may substitute a similar Bus if necessary, with your prior approval.
3. Payment Terms
  • The total Hire fee is quoted based on distance, duration, and services (e.g., Driver, amenities). Additional charges apply for extras like overtime, waiting time, tolls, parking, or night surcharges (10 PM – 6 AM).
  • Full payment is due 48 hours before the Hire start, via bank transfer, UPI, or cash. Late payments may result in cancellation without refund.
  • All fees are non-refundable except as per Section 10. GST (as applicable) is additional.
  • Security deposit: INR 10,000 (refundable post-Hire, subject to deductions for damages or cleaning).
4. Rental Period and Schedule
  • The Hire Period commences at the agreed pickup time and location. Delays by the Hirer may incur overtime charges.
  • The Bus must be returned (or dropped off) at the end of the Hire Period. Extensions require prior approval and additional payment.
  • We aim for punctuality but are not liable for delays due to traffic, road conditions, or Force Majeure.
5. Use of the Bus
  • The Bus is hired solely for lawful passenger transport on public roads. You must not exceed the maximum seating capacity (as displayed) or use the Bus for commercial purposes without our consent.
  • The Hirer is responsible for loading/unloading luggage, ensuring it fits safely without obstructing aisles or emergency exits.
  • Smoking, consumption of alcohol, drugs, or hazardous materials is strictly prohibited. Violations may lead to immediate termination and forfeiture of fees.
6. Driver Services
  • If a Driver is included, they must be treated respectfully and provided reasonable breaks. The Driver’s instructions on safety and routes are final.
  • You may not direct the Driver to engage in unsafe driving, exceed speed limits, or deviate from the itinerary without our approval.
  • Drivers are not permitted to carry passengers beyond the booked number or assist with personal tasks unrelated to the Hire.
7. Hirer and Passenger Responsibilities
  • All Passengers must wear seatbelts, follow safety protocols, and behave responsibly. The Hirer supervises all Passengers, including minors (no unaccompanied children under 12).
  • Report any defects or issues with the Bus immediately upon pickup or during the Hire. Continued use implies acceptance.
  • The Hirer indemnifies us against claims arising from Passenger misconduct, including damage to the Bus or third parties.
8. Prohibitions
  • Illegal activities, overloading, off-road use, or towing are forbidden.
  • No alterations to the Bus (e.g., stickers, modifications) without permission.
  • Compliance with all applicable laws, including health protocols (e.g., masks if mandated), is mandatory. We reserve the right to refuse boarding to non-compliant individuals.
9. Insurance, Liability, and Damage
  • The Hire includes third-party liability insurance as per Motor Vehicles Act, 1988. Comprehensive coverage for the Bus is our responsibility; personal insurance for Passengers is your obligation.
  • We are not liable for loss, damage, injury, or delay to Passengers, luggage, or property, except for proven gross negligence on our part.
  • You are liable for any damage to the Bus (e.g., scratches, stains, mechanical harm) caused by misuse, charged at actual repair costs plus 20% administration fee.
  • In case of accidents, cooperate fully with authorities and our insurers. Report incidents to us immediately.
10. Cancellation and Refunds
  • Cancellations must be in writing. Policies:
  • 7+ days before Hire: Full refund minus INR 1,000 processing fee.
  • 48-96 hours: 50% refund.
  • Less than 48 hours: No refund.
  • Force Majeure cancellations by us entitle you to a full refund or rescheduling. No refunds for Hirer-caused no-shows.
11. Termination of Hire
  • We may terminate the Hire immediately (without refund) for breaches like safety violations, illegal use, or non-payment.
  • Upon termination, you must vacate the Bus promptly. We may arrange alternative transport at your expense.
12. Force Majeure
  • Neither party is liable for non-performance due to Force Majeure. We will notify you promptly and work towards resolution (e.g., rescheduling).
13. Governing Law and Dispute Resolution
  • These Conditions are governed by the laws of India, with exclusive jurisdiction in the courts of [Insert City, e.g., Mumbai], Maharashtra.
  • Disputes shall first be attempted to be resolved amicably within 30 days. Unresolved matters may proceed to arbitration under the Arbitration and Conciliation Act, 1996.
14. General Provisions
  • These Conditions may be amended with notice. The version at booking applies.
  • No waiver of any breach constitutes a waiver of future breaches.
  • If any provision is invalid, the remainder remains enforceable.

Acceptance: By signing the booking form, paying the deposit, or commencing the Hire, you confirm you have read, understood, and agree to these Conditions. This contract is binding on your heirs, successors, and assigns.
